Hey why do people say second-hand items are brand new if it’s never or rarely been used? You bought it from the store and got it home, it shouldn’t have “brand new” status

I got into an argument with a seller over this. It was an iPad, bought a month ago, never opened for whatever reason, and she commanded a price identical to the store’s. I said that’s wrong because any items you buy and take into your possession are now considered to be “consumed” items as the consumer. If you buy a car, and they deliver it to your house, it’s not brand new anymore right? On top of this, the timer for the warranty started ticking a month ago.

I’m asking here because I might not be aware of a law or something else. Dito ko lang din napansin 'to. What am I missing here? I’m open to being completely wrong about this, it just doesn’t make sense to me that this person sees buying from them & buying from the store are the same thing.

That’s considered brand new to me. been to a few fb groups reselling of audio items (iems/headphones) and that’s considered 10/10.

Your example is not good either, they 2 are very different products, also the car is used at the time, clearly. If the user opened the iPad and checked it if its working then that’s more similar since in this case the iPad was used.

edit: sample of a rating item condition in HEX an audio group in fb(8.8k members):
      • Brand New/Sealed - Never been opened and brand new
      • Mint - Opened but never used - item complete
      • Excellent - Opened and used but in perfect condition
      • Very Good - Opened, used no issues but cosmetic imperfections
      • Good - Opened and used with issues like minor scratches and chips
      • Fair - Open and used with heavy cosmetic damage or worn parts such as pads
      • Poor - Open and used heavily with cosmetic damage, worn parts, pads, etc.
      • Very Poor - Does not work, needs repair, major damage.
