I saw some rumors that it was just a malicious 3rd party imitating Nintendo DMCA’s. It would explain why Nintendo would care about a 15+ year old game.
Nintendo does takedown like this all the time. I haven’t seen anybody actually point at evidence of fraudsters, and there is no reasonable benefit to doing this as a fraud. There is no avenue of profit.
